      The holidays featured on this website are operated by Wine Rides Limited. (A company registered in England and Wales number 8433242 having its registered office at 18 Tudor Road, London, SE19 2UH).

 

For your financial protection Wine Rides Ltd is a member of Trust My Travel and our membership number is TMT0312. All client money, whether by bank transfer or card payment is paid into an independently managed Trust Account held at Barclays Bank in the UK. This means in the unlikely event of our financial failure you will receive a refund for the services you have paid for. Money is not received by us until all suppliers have been paid and you have completed your trip. Trust My Travel is Authorised and Regulated by the Financial Services Authority under the PSR 2009: No. 569641. All bookings are made and accepted in accordance with the terms and conditions set out below. These conditions of booking and information on this website, set out the terms on which you contract with Wine Rides Ltd. They shall be governed by and construed in accordance with English law, being subject to the jurisdiction of the Courts of England and Wales. No variation shall be of any effect unless in writing and by the authority of Wine Rides Limited.

A “Wine Rides Tour” is a three day cycling excursion, camping overnight at Carr Taylor vineyard and Sedlescombe Organic vineyard, both located in East Sussex. You will be given a route map and directions to guide your cycling for three days. The experience includes wine tasting at your two overnight vineyards, an evening meal and breakfast during your stay at each vineyard. You will be provided with a tent equipped with an airbed and bedding which has an occupancy of two people. Toilets and shower facilities are provided. Your baggage will transported to Carr Taylor vineyard on day 1, and onwards to Sedlecombe Vineyard on day 2 and your luggage will be returned to you at the end of your tour.

    1. Booking a Wine Rides Tour

To make a booking an online booking form must be completed and sent to us with a non-refundable deposit of 50% for each person (the “Deposit”). Alternatively, a booking can be made by giving the requested details over the telephone. By giving us your details and indicating your desire to book with us you will be deemed to have accepted the terms and conditions of our contract. Confirmation of the booking will normally be sent within 14 working days. The booking is not accepted and no contract exists until the date shown on the confirmation invoice. All attendees must be over 18 at time of booking. In line with the Consumer Protection (Distance Selling) Regulations 2000, the Customer has the right to cancel within 7 working days of receiving confirmation of booking, upon which a full refund will be given.

    1. Balance of payment.

The balance of your payment is due 8 weeks prior to the start of your Tour and bookings made within 8 weeks of departure must be paid for in full at the time of booking. Failure to pay the balance by the specified time will result in the cancellation of your holiday and the imposition of the relevant cancellation charge as set out in paragraph 4 below.

    1. Alterations by you

 

      1. Subject to availability, and an administration fee of £40 per booking, you may change the date of your holiday arrangements after the issue of a confirmation invoice, and subject to you covering any associated costs of the amendment imposed by our suppliers. Please note a confirmed change of booking for one person does not necessarily imply availability for another. Any transfer to another holiday within 4 weeks of departure will be treated as a cancellation and rebooking.

 

      1. Where the consumer is prevented from proceeding with a Wine Rides Tour, the consumer may transfer the booking to a person who satisfies the requirements of these terms and conditions, provided the customer gives reasonable notice to Wine Rides of your intention to transfer before the start of the Wine Rides Tour. In the event of a transfer, the transferor and the transferee are jointly and severably liable to Wine Rides Ltd for payment of the price of the package, and any additional costs arising from a transfer, such as bike hire.

 

    1. Cancellation by you

Should you or any member of your party wish to cancel the holiday you must telephone us at once. Such notice of cancellation is effective only when received by us in writing. As we incur costs from the moment we receive your booking, we charge cancellation fees on the following scale:

      1. Over 8 weeks prior to departure – If the cancellation is received prior to the balance due date (as set out in paragraph 2 above), we will retain the Deposit. However, you may ask for your Deposit to be transferred to another Wine Rides Tour that is due to start in the same calendar year, but this will be strictly subject to availability.
      2. 4-8 weeks prior to departure – If the cancellation is received 4-8 weeks prior to departure, loss of 75% of the total Wine Rides Tour cost. To avoid the cancellation cost, you may ask to transfer to another Wine Rides Tour that is due to start in the same calendar year, but this will be strictly subject to availability.
      3. 0-4 weeks prior to departure – Loss of 100% of the total Wine Rides Tour cost.

 

    1. Modifications by Wine Rides

It is unlikely that we will have to make changes to your Wine Rides Tour, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. We may modify the recommended cycling route, location of evening meals and vineyard camping sites.

      1. Minor changes may include but not be limited to modifications to the recommended cycling route, for example due to local events or road closures. We may also use local restaurants instead of on site catering for small groups.
      2. Major changes may include but not be limited to changes to the departure date. This will only change in the event that one of our suppliers is unable to accommodate campers due to unforeseen circumstances, such as family illness or flooding.

If we make a major change to your Wine Rides Tour, we will inform you as soon as reasonably possible. In the event of a major change, you will have the choice of either accepting the change of arrangements, accepting an offer of an alternative Wine Rides Tour of comparable standard from us, or cancelling your booked Wine Rides Tour and receiving a full refund of all monies paid. If we are only able to offer a Wine Rides Tour of a lower standard, we will compensate you for the difference in price between the original Wine Rides Tour booked and the substitute offered.

If you cancel a Wine Rides Tour as a result of us making a major change that is a significant change to an essential term of this contract, and you do not accept a substitute Wine Rides Tour, you may be entitled to compensation where appropriate in accordance with the table set out in paragraph 8 below.

    1. Cancellation by us

We will not cancel a holiday unless:

      1. We are forced to do so by unusual or unforeseen circumstances known as “force majeure” which will include (but shall not be limited to) war, threat of war, riot, civil or political unrest, industrial dispute, terrorist activity threatened or actual in its consequences, natural or nuclear disasters, fire, adverse weather conditions, closure of ports or airports, air traffic control delays, technical problems of transport or other circumstances amounting to force majeure.
      2. If the minimum number of people required to operate the Wine Rides Tour has not been reached. We will notify our customers as soon as possible and no later than 7 days before the start of your tour if the minimum occupancy has not been reached.
      3. you have failed to pay the Deposit or balance of the payment due by the due dates for such payments (please see paragraphs 2 and 4 above).

We reserve the right to cancel a Wine Rides Tour for reasons other than those set out in paragraphs 6(a) to 6(c) above. If we do decide to cancel a Wine Rides Tour for any reason(except for the reasons in paragraph 6(c) above) we will, if possible, offer an alternative tour of equivalent or superior quality to the original tour booked. If we are only able to offer an alternative tour of lower quality to the original tour booked, you are entitled to recover the difference in price between the original tour booked and the substitute tour. If this is not acceptable to you then a full refund will be given.

If we cancel a Wine Rides Tour for reasons other than those described in paragraphs 6(a) to 6(c), you may be entitled to compensation where appropriate in accordance with the table set out in paragraph 8 below.

    1. Price changes

Prices featured in our published materials or listed on our website are accurate at the date published, but we reserve the right to increase or reduce the prices from time to time. We will ensure that the prices featured in our published materials or listed on our website are accurate at the date of booking.

Once a confirmation invoice has been issued we will endeavour to abide by that price. However, we may be forced to increase the price after a confirmation invoice has been issued due to increases in transportation costs (including the cost of fuel), dues, taxes, fees or exchange rates. We will inform you of any price increases no less than 30 days prior to the date of the Wine Rides Tour.

If a price increase is 2% or less of the total price you have agreed to pay for a Wine Rides Tour, we will absorb such price increase and will not charge you the increased price.

If a price increase is 10% or more of the total price you have agreed to pay for a Wine Rides Tour (a “Significant Price Increase”) and you do not accept the price increase, you may cancel your booking and we will refund the price you have paid for the Wine Rides Tour. If you decide to cancel your booking you may be entitled to compensation as set out in the table at paragraph 8 below.

    1. Compensation in respect of cancellation

You may be entitled to the following compensation in the event of cancellation in the circumstances below:

      1. if you cancel a Wine Rides Tour as a result of us making a major change that is a significant change to an essential term of this contract, which will include a major change set out in paragraph 5(b);
      2. if you cancel a Wine Rides Tour as a result of us making a Significant Price increase as set out in paragraph 7 above; or
      3. if we are forced to cancel a Wine Rides Tour for reasons other than those set out in paragraphs 6(a) to 6(c) above:

We reserve the right to vary the scale of compensation given in the table above depending on the circumstances in which the Wine Rides Tour is cancelled and the notice periods given prior to cancellation.

    1. Bike rental and identification

 

      1. We will hire bikes on behalf of our customers, providing this is requested no less than 7 days before the start of your Wine Rides Tour. There is an additional charge of £30 which includes bike hire, spare inner tube, tools and loan of a helmet. All customers being loaned a bike will need to bring their passport which will be held by Wine Rides and returned to you at the end of your Wine Rides Tour.
      2. It is the customers’ responsibility to return the cycle in a similar condition at the end of the hire period. Fair wear and tear is included in the hire charge.
      3. Customers must use the cycle in a proper and careful manner for social and domestic purposes, and not to use the cycle for racing and / or for reward
      4. Customers must secure the cycle when left unattended, by locking the front wheel and frame to a permanent fixture by means of the lock provided.
      5. Customers are responsible for loss or damage to the bike and any accessories.
      6. Wine Rides reserve the right to claim additional monies from the customer for any loss or damage to the cycle, in line with fees charged by the hire company.
      7. All bikes must be returned at the end of the hire period (at the end of you final day of cycling)

 

    1. Risks and Hazards

Your booking is accepted on the understanding that you realise the risks and hazards of such a holiday, including the dangers inherent in cycling either on the road or off the road, or the dangers inherent in the other activities included in individual holidays. It is your responsibility to ride with due care at all times. If in doubt you should walk where you are not confident to ride. Whilst you are under no legal obligation to wear a helmet it is the official advice of Wine Ride Ltd recommends that you do while cycling.

If you do experience a near miss or are in an accident, you are obliged to inform the most senior member of Wine Rides staff at the earliest opportunity. You will need to give details of the nature of the incident and location. You will be staying on a working vineyard and your booking is accepted on the understanding that you realise the risks and hazards that may be associated with this camping location. Your booking is accepted on the understanding that you realise the risks of such holidays in terms of potential for delay and alterations, due to possible changes in local politics, weather, disease, loss or damage to property, inconvenience and discomfort.

    1. Helmets and clothing

Wearing a cycle helmet is not required under UK law. However, Wine Rides strongly recommends that all customers of Wine Rides follow the recommendations set out in the Highway Code. Rule 45, the first of the specific rules for cyclists states: You should wear:

      • a cycle helmet which conforms to current regulations
      • appropriate clothes for cycling. Avoid clothes which may get tangled in the chain, or in a wheel or may obscure your lights
      • light-coloured or fluorescent clothing which helps other road users to see you in daylight and poor light
      • reflective clothing and/or accessories (belt, arm or ankle bands) in the dark.

Wearing a cycle helmet remains a matter of personal choice and whether a helmet is worn while cycling on a Wine Rides Tour is a decision to be taken by the customer. If you wish to hire a bike for your holiday through Wine Rides, you must also let us know whether you require a helmet and what size.

    1. Personal wellbeing

In booking this holiday and accepting these terms and conditions, you are verifying that you understand the nature of all activities involved in a Wine Rides Tour, that you are of sound body and mind and are in good general health. Any relevant medical conditions must be declared accurately upon booking and by booking a Wine Rides Tour, you are verifying that no medical condition that afflicts you will be negatively affected by your participation in a Wine Rides Tour. Wine Rides are not in a position to advise Wine Rides customers whether they are medically fit to participate. If there is any doubt, customers must discuss their participation with a medical professional before booking.

    1. Cold or Hot environment

By its very nature a Wine Rides Tour requires the participants to be outside for an extended period of time. This means that patrons may be exposed to hot, cold, wet and dry weather conditions.

Whilst Wine Rides Ltd will do what it reasonably can to advise clients, protect clients from and mitigate the effects of weather conditions on clients, by accepting these terms and conditions patrons are accepting that they share responsibility in protecting themselves against exposure. Wine Rides Ltd will provide advice in the form of a kit list containing items of clothing and sun protection that is recommended for the forecast weather conditions that weekend. However it is responsibility of the client to ensure that they come equipped with those items and that they ensure these protective items are of a sufficient standard to protect them against the weather and keep them comfortable. You also acknowledge that this advice is based the best information we have available to us and it may be necessary for you to purchase further equipment if the weather condition change suddenly or the equipment you have come with proves to be inadequate.

    1. Duty of care

 

      1. We do our best to provide you with the photographs and illustrations which should give you an impression of the Wine Rides Tour and facilities offered. These photographs and illustrations aim to give you an idea of the standard of the facilities, but are not contractually binding.
      2. We accept responsibility for ensuring that the Wine Rides Tour which you book with us, is supplied as is described on our website. If any part of your Tour is not supplied as promised due to the fault of our employees, agents or suppliers, we will pay you appropriate compensation if this has affected the enjoyment of the Tour.
      3. We have no liability whatsoever in connection with travel to and from the designated start and finish point for the Tour and it is your responsibility to make suitable travel arrangements.
      4. Facilities available outside of the tented accommodation at the Vineyard (lunch stops, additional wine tasting and tours en route and other activities that you may undertake during your cycling tour) will remain under the sole responsibility of the outside providers who organised or provided them.
      5. The contract is made on the terms of these booking conditions, which are governed by English Law and the jurisdiction of the English Courts.

 

    1. Complaints

We are committed to providing an excellent service to our customers. If you have a problem during your tour, you are obliged to inform our Wine Rides staff immediately who will endeavour to put things right whilst you are on site. If your complaint is not resolved during your stay, please follow this up in writing within 14 days of the end of your tour. You must communicate any complaint to our local staff without delay and complete a report of your complaint while on site. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on the tour and this may affect your rights under this contract.

    1. Baggage and personal effects

All baggage and personal effects are at all times at your risk. We will not be responsible for any loss, damage or accident to any luggage or personal property, save where due to our negligence.

    1. Liability

Nothing in this contract shall exclude or limit our liability for:

      1. Death or personal injury resulting from negligence;
      2. Fraud or fraudulent misrepresentation; or
      3. Damage caused to you as a result of our failure to perform the contract or improper performance of the contract (except where such failures are due to you, is attributable to a third party unconnected with the provision of a Wine Rides Tour or is due to unusual and unforeseeable circumstances).

Our liability in the circumstances above in respect of damage to your personal property shall be limited to the level of our insurance cover. Except where we are liable for personal injury and fraud, our total liability in respect of the circumstances above shall be limited to the cost of your Wine Rides Tour.

    1. Personal Insurance

The client is responsible for any loss or damage to baggage, customer’s own bicycles or personal possessions or any consequential loss resulting there from. You should be adequately insured against loss, theft or damage. You should keep valuables safely with you at all times. For your safety and convenience we strongly recommend that clients have travel insurance for holidays in UK.

    1. Client behaviour

You have a duty of care to yourself, your fellow Wine Rides Patrons, to members of Wine Rides Staff and our partners.

You must at all times observe the advice of our staff regarding conduct on the roads and it is your responsibility to take care of the bicycle which may be allocated for your use during the course of your tour. If you feel another Wine Rides Patron is behaving inappropriately at any point during the Tour, you must inform a member of Wine Rides Staff who will deal with the situation. We reserve the right in our absolute discretion to terminate your holiday immediately if your behaviour is likely, in our opinion or that of our partners, to cause distress, damage, annoyance or danger to our employees or to any third party or their property. We will impose full cancellation charges and will not give any refunds. Furthermore, we will be under no obligation whatsoever to pay you compensation or cover any costs you may incur as a result of having to make alternative arrangements.

    1. Litter

Wine Rides Ltd is committed to the preservation of the British countryside’s beauty and promoting cycling as an activity to the population in general. Therefore we request that you should under no circumstances leave litter behind you while you are participating in one of our tours.

    1. Consumption and purchase of alcohol.

Customers will have the opportunity to sample and purchase alcoholic beverages as part of the Wine Rides Tour. Only beverages purchased at one of the designated vineyard camping locations may be consumed on site. Wine Rides is committed to promoting responsible drinking. The UK Government advises that men drink no more than three to four units a day and women no more than two to three. In some situations, such as pregnancy, it is better to drink less or not at all.

Furthermore it is the responsibility of Patrons to be aware of how much alcohol they are consuming and to be aware of how long it will take them to metabolise this alcohol and be safe to cycle or drive on the roads after any part of the Wine Rides Tour.

    1. Illegal substances

Any use of illegal substance will result in the immediate termination of your holiday. We will impose full cancellation charges and will not give any refunds. Furthermore, we will be under no obligation whatsoever to pay you compensation or cover any costs you may incur as a result of having to make alternative arrangements and the relevant authorities will be contacted.

    1. Smoking

Under no circumstances must you smoke in either your sleeping tent or the dining tent. Clients are allowed to smoke on the vineyards and around the campfire, but we ask that you do this with consideration for the other clients. If your smoking is disturbing another client, then their need not to be disturbed comes first, and we ask that you move away from them, so your smoking is not bothering them.

    1. Food policy

Whilst Wine Rides Ltd is an inclusive package and we will do our best to provide customers with a healthy and generous: breakfast, dinner and snacks for the day, we do not restrict the number of miles participants cycle, nor do we claim to know how much nutrition or hydration an individual patron may need for the amount of exercise they will do during the tour. Therefore by accepting these terms and condition you are acknowledging that you share responsibility in ensuring that you have eaten the correct amount and consumed enough hydrating liquids.

Patrons will be made aware of places to go for lunch, but Wine Rides cannot be held responsible if for some unforeseen reason these establishments are closed. Patrons accept that they have a responsibility to ensure that they have taken on the correct amount of food to enable them to do the exercise required during a Wine Rides tour and remain happily satiated.

By accepting these terms and conditions you acknowledge that Wine Rides has a healthy food policy based on empirical evidence and as such will not automatically supply sugary soft drinks such as Coca-Cola, Sprite and fruit juice unless specifically requested ahead of time.

Wine Rides Ltd wishes to encourage and facilitate a healthy life style and has made commitment to using whole foods. Whilst sweet deserts will obviously contain sugar, efforts have been made by Wine Rides Ltd to ensure that all other foods we serve are free from “Added sugar”, this is to ensure that our clients and staffs can enjoy an environment that is not obesogenic.

By accepting these terms and conditions you confirm that you have read and understood our typical menu. If the food listed is not adequate for your needs then you must discuss your specific needs with Wine Rides Ltd before you book.
